Disclaimers for Bidder :

You must buy a paddle in order to be in an auction. Auctions are done with carrots not paddles. Purchasing paddles does not guarantee the successful bid on an item. Paddle costs shall be refunded and credited to your account if an auction is withdrawn. |

|
You the bidder are required to be diligent in reading item/property descriptions and viewing photos. Sellers are responsible for the accuracy of their listings. Powabunga does not guarantee nor take responsibility for the accuracy of the seller listings. |

| 3. |
|
Once an item has reached its reserve you shall be informed via email of the auction start time. Auctions start 24 hours after the last paddle has been purchased. Individual auctions are active for 24 hours from the time of their commencement. |

| 4. |
|
If you are the successful bidder on an item/property, and you select the "cash option," you have the option of either taking possession of the property or letting the seller keep their property, with you the successful bidder receiving 75% and the seller receiving 25% of the seller's price(not inclusive of the the Powabunga commission). |

| 5. |
|
If an item/property does not generate enough interest to meet the reserve price prior to the expiration date of its listing, it will not be auctioned and you agree to not hold Powabunga liable for the lack of a sale. However, you will be credited back your paddle purchase which can be used to purchase future paddles, and you will keep the carrots you have collected while that item was open for paddle purchases. |

When both you and the seller inform Powabunga that you the bidder have taken possession of the property, or that a closing date has been set, Powabunga will mail a check or send a wire transfer to the seller, payable in U.S. Dollars, within 48 hours of receiving confirmation of the property transfer. |

You will be notified via your Powabunga homepage and email if you are the successful bidder. |
| |
| 8. |
|
You, not Powabunga, are responsible for knowing and obeying the tax and customs laws of your state/country jurisdiction; and you agree to not hold Powabunga liable for any issues that arise between you and any government entity resulting from your purchase of property via Powabunga. |

| 9. |
|
You agree to settle all disputes with Powabunga through arbitration under the laws governing the State of Florida, U.S.A. |

Disclaimers for Seller :
| 1. |
|
If you post photos that are stock photos, not the actual photos of your property, this must be noted in the description or restrictions section on the listing page. |

| 2. |
|
Once you list an item, you cannot raise the reserve price, but you can lower it. |
| |
| 3. |
|
When you check the "cash option" when listing the property, you have given the successful bidder the option of either taking possession of the property or letting you keep your property, with the successful bidder receiving 75% and you receiving 25% of the seller's price(not inclusive of the Powabunga commission). |

| NOTE : |
In order to be paid for your sale you must obtain a signed receipt as evidence that the item you have sold has been received by the successful bidder of your property, or you will not receive payment for your sale. (This is not required for the cash option.)
